FAQ

With the proper evidence, your attorney can prove your lack of liability in your car crash, which makes the insurance company offer you the maximum insurance amount. The evidence your car accident attorney queens might need includes a copy of the police report, medical records, witness statements, photographs from the crash scene, and a statement from your doctor that outlines the severity of your injuries.

Most victims are worried about recovery compensations post their accidents, as car accidents can leave them in a severely compromised financial state. They have to deal with medical expenses and property damage and even might have to take time off from work to recover. A personal injury lawyer might not be able to provide you with an exact amount during the initial filing phases. Still, the lawyer can help you understand the benefits you are eligible to recover. The attorney will do everything possible to obtain maximum compensation from the insurance company, even if this involves going to court.

Uninsured driver claims offered by eligible insurance plans may offer some car accident victims compensation for damages post crash. However, the coverage will not likely be enough to cover the total damage costs you sustain. Sometimes, you can even file a lawsuit against the driver directly. You must talk to your attorney about this, as they will help you determine your claim’s ideal course of action and produce a favorable result.

Multiple factors can affect how long you have to file a claim for compensation after a car accident. You generally have three years to file your personal injury claim from the accident date

Car accident injuries can be highly severe. Some of the common injuries are:

Traumatic Brain Injury: Brain injuries are life-hampering and devastating and can create confusion, problems with language and speech, concentration troubles, motor control issues and several other disabilities.

Whiplash: Injuries caused by tearing or shearing the muscle tissue following an abrupt change or violent impact in speed are known as whiplash. Whiplash causes the victim’s head to snap back and forth in a powerful motion resulting in muscle and soft tissue damage.

Broken Bones: Severe car accidents can cause broken bones that usually take months or years to heal. In some situations, broken bones can permanently change how your body functions.

Car accident cases involving Lyft and Uber can become complicated as you might have to file your claim either against the driver or the rideshare company. It will depend on the rideshare app’s status at the time of the car accident and whether the driver had a paying ride in progress.

If you possess the appropriate coverage, an uninsured driver can offer you compensation for some of your damages. Be cautious, as even your insurance company can try to lowball your settlement amount. You can also use the driver directly, but we first need to determine if the driver possesses the assets to offer you compensation.

New York State follows a strict statute of limitations for car accident injury claims. If you fail to file a legal claim before the statute of limitations runs out, you are likely to lose the ability to take any action. All motorists in New York must purchase no-fault insurance coverage. When an accident occurs, their initial claim is against their no-fault policy. The policy benefits apply regardless of who caused the accident. However, you can file for a personal injury claim directly against a negligent driver a trucking company, or any other fault party in certain situations.

Many car accident victims need not immediately feel pain or injury from a car accident and can even refuse medical care. However, pain from sustained injuries can sometimes be delayed. This is often the case for soft tissue damage. Any muscle, ligament or tendon damage is considered soft tissue damage. In case you are pursuing legal action with a personal injury claim, in most cases, insurance companies consider it reasonable to obtain medical care within 72 hours of the accident.
