Boat Accident

Long Island Boat Accident Lawyer

If a boating wreck has left you injured and someone else was at fault, you could have grounds for seeking compensation. Find out by consulting a Long Island boat accident lawyer.

People often overlook the possibility of a boating accident when they go out onto the water, but the likelihood of a mishap that leads to serious injuries is every bit as possible as it is with car crashes. The presence of so much water also makes suffering a brain injury that leads to unconsciousness particularly dangerous, as drowning or further brain damage due lack of oxygen become very real possibilities.

When you’ve been hurt in a watercraft crash, you might be eligible to recover financial compensation if someone else was at fault for what happened. To ensure that you get the most from your claim, work with a Long Island boat accident lawyer from Siler & Ingber, LLP. We can collect all of the necessary evidence and properly evaluate the cost of your damages and losses.

Investigating the Boating Wreck

A successful personal injury claim is built on evidence and witness testimony. In order to collect all of the available evidence to support your case, your Long Island boat accident lawyer will investigate what happened in order to determine who was at fault and how. This is critical, as it’s completely possible that more than one party will be at fault. New York observes comparative negligence, so in order to collect full compensation, we’ll need to name everyone responsible in your claim, as each negligent party is responsible for his or her share. These are just a few of the factors that will need to be considered, depending on your unique case:
  • Distracted boating or reckless operation
  • Speeding (waterways have speed limits, too)
  • Intoxication, whether by drugs or by alcohol
  • Defective boat parts or safety equipment, such as life preservers that failed to float
  • Negligent conduct by pier or dock workers

Watercraft Accident Injuries

Whether you were injured on a yacht or a Jet Ski, the specific injuries you suffered will have the greatest impact on the amount of compensation you can recover. The extent of your injuries, how long your recovery will take, their impact on your quality of life, and what medical care will be required will all need to be determined with the help of your doctor before an accurate value can be placed on your injury claim. Your Long Island boat accident lawyer will have extensive experience litigating claims for a variety of different catastrophic injury types:
  • Broken bones
  • Internal bleeding and organ damage
  • Traumatic brain injuries and brain damage caused by lack of oxygen
  • Spine and neck injuries
  • Wrongful death, such as caused by drowning

Compensation for Boat Wreck Damages and Injuries

Even if the negligent party’s insurer or attorney approach you with a settlement offer, you should never accept it without first having a Long Island boat accident lawyer from our firm review it. Initial offers are usually lower than what they should be, as the liable party is trying to get you to settle for as little as possible in order to reduce their costs.

The compensation you receive needs to be comprehensive: It should cover both your current and future costs, and it should cover both your financial expenses and your non-economic damages. Financial expenses are obviously any losses with an associated dollar amount, but many watercraft accident victims don’t realize that they can get compensated for non-economic damages, which reflect how their injuries have compromised their quality of life.

These are just a few examples of damages you might be able to demand compensation for in your personal injury claim:

  • Medical bills for surgeries checkups, medication, and equipment
  • Lost income and reduced future earning ability
  • Transportation costs
  • Boat repair and cost to replace any other damaged personal property
  • Pain and suffering
  • Emotional trauma
  • Lost enjoyment of life
