Additionally, some car accident victims sustain severe injuries that cost even more of your hard-earned money to pay for medical bills and prescriptions. The unluckiest victims suffer from disabling and permanent damages that can result in a lifetime of recovery. Sadly, the worst car accidents can even result in death.

When the negligence of another party causes your car accident, a whole new level of pain and suffering is added to your list. At the law firm of Siler & Ingber LLP, we have seen countless cases of car accident victims who have been blindsided by the number of damages after a crash. Get Compensation for Your Injuries and Crash Damages

Too many accident victims rely on their insurance companies to provide the financial support they need to recover from a severe accident. Unfortunately, insurance companies are for-profit businesses you don’t always have your best interests in mind. These companies look to reduce expenses whenever possible and are not likely to shell out the maximum benefit without a fight.

Even when you receive the maximum benefit from your insurance company, this sum is often far less than the average car accident victim requires to pay for the total number of damages sustained after a crash. These amounts often forget to consider the long-term medical needs, only focusing on the upfront costs that could be required for emergency medical costs and services.

By seeking representation from an experienced Brooklyn car accident lawyer,
your chances of recovering the financial support, you need for a full recovery skyrocket. Our team takes a comprehensive look at your case to establish a more realistic cost of damages sustained after an accident that often increases when serious injuries are involved. These damages may include:

  • Any medical bill or treatment cost associated with injuries sustained in an accident (follow up appointments, surgeries, prescriptions, medical equipment);
  • Repair costs for vehicle damage;
  • Therapy costs (emotional or physical);
  • Loss of income or reduced wages;
  • Loss of employment;
  • Pain and suffering;
  • Emotional distress and trauma; and
  • Reduced quality of life.

Laws in New York That Can Affect Your Case

New York State protects the rights of drivers who have been injured in an accident due to negligence or recklessness. All drivers have a duty to use safe driving behaviors to reduce harm to others on the road. When these expectations are not upheld and result in a serious accident, the liable party or parties should be held accountable.

New York is one of many states in our country that requires its drivers to hold “no-fault” insurance. No-fault means that both parties will need to file a claim with their insurance company to seek compensation for damages no matter who was responsible for a car accident. No-fault plans help to reduce the number of lawsuits filed in court to fight for financial support when it comes to immediate medical damages after an accident. Car accident victims can be reimbursed up to $50,000 for accident-related medical costs and 80% of lost wages with a maximum of $2,000 a week.

Accident victims who sustain severe injuries in a car accident that exceed the $50,000 maximum benefit amount may file for additional compensation if they can prove their accident was caused by negligence. Evidence provided by victims must show that the injuries sustained were severe, disabling, or disfiguring, or that the accident resulted in wrongful death. This can be especially difficult to complete alone, especially when you are trying to focus on recovering.

Our attorneys at Siler & Ingber have been representing car accident victims in Brooklyn for over 20 years. We understand the requirements the court is looking for to file a successful personal injury claim and how to avoid the pitfalls so many victims find themselves in when trying to gather evidence on their own. We go beyond the scope of immediate injuries you sustain and determine the number of actual damages when establishing a fair compensation amount. Our team fights for your right to stand up to the parties who have caused you harm and allow you to focus on your recovery with peace of mind and without the burden of financial hardships.

Calling to consult an experienced Brooklyn accident attorney is a crucial step in the aftermath of your car accident. In New York State, car accident victims only have three years from the date of the accident to file a claim for compensation. This may appear to be plenty of time to report an accident, but filing accident claims involving negligence are not always that simple. It takes time to gather sufficient evidence and documentation to prove liability in a car accident. The longer you wait to file, the more of a chance that valuable evidence will be harder to find, particularly when it comes to witnesses and accident scenes.

As soon as you are healthy and able, call a Brooklyn car accident attorney to discuss your options. Allowing your attorney ample time to put together a convincing case is the best way to maximize rewards when seeking compensation for your injuries. Accident attorneys can also assist you in filing your insurance claim correctly to avoid being denied for simple mistakes or missing information.

Are Accident Attorneys Worth It?

This is one of the most honest questions a client can ask. When it comes to seeking damages after a car accident caused by negligence, the compensation you can acquire to help you in your recovery is definitely worth giving an accident attorney a call.

In these car accident cases, clients can incur tens of thousands of dollars in medical costs, from surgeries to medications and often a lifetime of follow-up treatments. These claims have specific requirements that are tedious and often require the help of specialists to prove who was liable for your injuries. Experienced Brooklyn car accident attorneys have access to the specialists needed to attest to the severity of damages sustained secure the maximum amount you deserve.

What is the average settlement for a car accident with injury?

Because every car accident is different, it can be difficult to determine an average settlement amount for a claim. Your Brooklyn car accident attorney will be able to give you a more realistic settlement amount once they have evaluated your case and totaled the number of potential damages. Factors that can increase your settlement amount include extensive injuries involving disfigurement, disabilities, or invasive surgeries, or instances where the party responsible for your accident was under the influence of drugs, alcohol, or obvious distractions.

What pieces of evidence do I need?

Evidence is the most important component of any personal injury case. Evidence can include anything from photographs, videos, police reports, medical documents, or statements from witnesses present at the time of your accident. These crucial documents and accounts are the bread and butter to a successful personal injury case and often require the use of multiple resources to acquire.

Do I have a viable case?

Brooklyn car accident attorneys do more than just secure compensation for severely injured victims. Because New York is a no-fault state, all accident victims are required to file an accident report with their company, and these reports are not always as straightforward as they appear. Insurance companies are always looking for a chance to save costs, even it means with holding benefits from an accident victim due to a technical error. An experienced accident attorney can help you file your insurance claim in a way that maximizes your chances of receiving full compensation without falling victim to common errors.

Who is responsible for dangerous road conditions?

A single-car accident does not automatically disqualify you from filing a personal injury claim. We have seen many cases where drivers fall victim to poorly kept roads or dangerous roads with inadequate signage. In these cases, you may be eligible to file a claim against the municipalities or companies who have been contracted to maintain the roads where your crash occurred. Your Brooklyn car accident attorney will look into these possibilities to determine who was at fault and what steps should have been taken to prevent the accident.

Who do I seek compensation from if I was hit by a rideshare driver?

Uber and Lyft accident claims can be tricky, but they are not impossible. As more New Yorkers shift their transportation preferences in favor of ridesharing companies, car accident attorneys are getting more clever in determining fault when injuries occur. A car accident victim may be eligible to seek compensation against a driver or the company depending on the status of the Uber or Lyft app at the time an accident occurs and whether the driver was transporting another rider.

What happens when I’ve been injured in a wreck with an uninsured driver?

Drivers who are involved in an accident with an uninsured driver may be eligible for compensation through their insurance company by filling an uninsured driver claim. These claims are offered through all types of car insurance plans and can be tricky. A Brooklyn car accident attorney can be crucial in helping you to adequately complete these forms and determine when to filing a settlement against the driver directly is more appropriate to secure the financial support you require.

How long do I have to file?

New York drivers have three years to file a personal injury claim to seek compensation after a car accident occurs. After this period, it is highly unlikely that victims will obtain monetary rewards for their injuries.

What does it mean that New York is a no-fault state?

No-fault is a type of insurance that requires all drivers involved in an accident to file a claim with their insurance company for compensation, regardless of who was responsible for the accident. No-fault states require drivers to carry this insurance to reduce the number of lawsuits in court related to proving fault in a car accident. This allows accident victims financial assistance for any immediate medical services they may need for injuries and damages.

For serious injuries, even in a no-fault state like New York, victims may be eligible for additional compensation depending on the severity of their injuries. A Brooklyn car accident attorney can play a crucial part in proving that additional income is necessary and in maximizing rewards for all damages sustained.

Am I at fault for a single-car crash?

There are several instances for why a driver may not be liable for the damages sustained in a single-car crash. Poor road conditions, inadequate signage, and malfunctioning car parts are just a few factors that can make you eligible to file an accident claim against a third party.

Should I get a lawyer after a minor car accident?

Being involved in a car accident is always concerning, even if it is relatively minor. You may wonder if it is worthwhile to speak to a car accident attorney following a minor collision. Whilst the need for an attorney is not always warranted, there are at times reasons for contacting a lawyer following a minor accident. Depending on the injuries, damages and who is at fault, there may be instances where you need advice from a car accident attorney. Most importantly you should evaluate your injuries. It is common in minor car accidents to sustain a small, soft-tissue injury that can develop into a more painful and serious injury. Your best bet is to discuss your legal rights and options with an experienced and trusted car accident attorney.

Types of Car Crashes

In an area as busy and congested as Brooklyn, car accidents are an everyday occurrence. Our team of experienced accident attorneys has seen it all. Some of the most common car accident types we have represented include:

  • – Rear-End Collisions- Rear-end collisions are common on congested roads, where stop- and-go traffic can lead cars to crash into the back of each other. These accidents are one of the most common collisions we come across and often result in injuries affecting the spine and neck (whiplash).
  • – T-Bone Accidents- A T-bone accident occurs when the front of one vehicle collides with the side of another. These types of wrecks most often occur in busy intersections when vehicles fail to stop.
  • – Sideswipes- When cars are packed tightly together in narrow lanes with side street parking, sideswipe accidents are inevitable. Sideswipes occur when the sides of two vehicles collide. This can be caused by swerving through lanes, drifting, or even as the result of poorly maintained roads.
  • – Roll-Over Accidents- Roll-over accidents in the city can be terrifying. These accidents occur when a vehicle with a high center of gravity tips over (sometimes multiple times) onto the side or roof. Roll-overs are common with large trucks, SUVs, and vans, often result in devastating damages.
  • – Head-On Collisions- Head-on collisions occur when two vehicles collide in the front. These types of accidents can be deadly when occurring at high speeds and frequently result in life-threatening injuries.

Identifying What Caused Your Car Accident

It’s not enough to say that negligence was the cause of a car accident. There are many factors that can be involved when proving liability that your Brooklyn car accident attorney will investigate when gathering evidence for your claim.

The common causes of car accidents include:

  • – Distracted Driving- If a driver is participating in any other task aside from keeping their eyes on the road, this is known as distracted driving. Distractions can include talking on the phone, eating, drinking, smoking, typing in GPS coordinates, texting, talking to passengers, or reaching for items in the front or backseats.
  • – Drunk Driving- Drivers who consume alcohol before they drive are at a higher risk for causing serious car accidents and injuries. Drinking and driving in New York is illegal—even one drink can prevent a driver from making safe decisions on the road.
  • – Speeding- Speeding is one of the most popular and deadly forms of aggressive driving nationwide. Speeding not only increases your risk for causing an accident but elevates the risk of serious and fatal injuries as a result.
  • – Drowsy Driving- Fatigued driving is a growing danger on American roads and highly prevalent in the commercial trucking industry. Drivers who are fatigued can fall asleep at the wheel, drift between lanes, or miss critical hazards on the road that leadx to accidents.
