What To Do After A Car Accident In New York

Expert Advice From Injury Attorneys At Siler & Ingber, Llp

At Siler & Ingber, our legal professionals understand the distressing nature of a car accident. The shock is profound, and the confusion can be overwhelming. Our team at Siler & Ingber is committed to fighting for your rights in the aftermath of a car crash, with the aim of getting you fully compensated for your losses.

Recommended Steps to Take Following a Vehicle Crash

Promptly Seek Medical Attention

It is crucial to seek immediate medical attention for yourself, passengers, drivers, or pedestrians who might have sustained injuries. Even if your injuries aren’t initially apparent, consulting a physician is advisable to address potential issues like sprains, back problems, or head injuries.

Call the Police

Dial 911 to request police and emergency medical assistance. The police will gather your statement, as well as statements from other drivers and witnesses. They will also document accident details and ensure the safety of the scene.

Take Plenty of Pictures

If equipped with a camera or video recorder on your phone, capture images or videos of the aftermath of the accident, injuries, vehicle damage, and other pertinent factors like road conditions, signs, signals, or skid marks. These visual records, along with diagrams if available, hold value as evidence when interacting with insurers and during potential legal proceedings to secure compensation for injuries.

Collect Supporting Evidence

If the other driver admits fault, try to have them provide a written note acknowledging their responsibility and photograph the note. Many initially-at-fault drivers may retract their admission later, underscoring the importance of robust evidence. Additionally, seek impartial witnesses who can corroborate the liability of another party.

Consult Legal Counsel Promptly

Before engaging with an insurance company or any other party regarding the accident, it’s crucial to consult a skilled attorney as soon as possible to safeguard your rights and interests.

Actions to Avoid Following an Automobile Accident

Refrain from Admitting Fault

Prior to conversing with anyone—drivers, witnesses, or insurance adjusters—consult a proficient car accident lawyer. Avoid conceding fault without familiarizing yourself with your legal rights.

Exercise Caution on Social Media

Exercise caution with social media platforms such as Facebook, Instagram, TikTok, Twitter, and blogs, as content can be used against you. Do not post anything online without first seeking advice from an attorney. Even seemingly unrelated photos, like those showing physical activities, might be misconstrued to challenge injury claims.

Additional Measures After a Car Crash

Once you’ve attended to your medical needs and confirmed the well-being of other involved parties, there are additional steps to remember:

  • Document the scene as extensively as possible considering your physical state. Take multiple photographs of the accident site, individuals present, and the intersection or location of the collision.
  • Collect the names and badge numbers of responding police officers. Ensure you know where to obtain a copy of the accident’s police report.
  • Exchange contact details with other involved drivers, noting:
  1. Names and contact information
  2. Insurance company name and policy number
  3. License plate number
  4. Driver’s license number
  5. Vehicle details, including model, type, and color
  6. Accident location
