Manhattan Uber Accident Lawyer

Manhattan Uber Accident Lawyer

Seeking compensation is not easy when an Uber driver causes a car crash. You must ensure that you get fully compensated by working with a Manhattan uber accident lawyer.

Ridesharing services like Uber have made traveling in Manhattan easier. All you need is a smartphone, and you can quickly download the Uber app and book a ride for yourself.

But, when a car accident involves an Uber driver, how do you know who’s responsible?
Although these drivers are employed by Uber and also covered by Uber’s insurance when carrying passengers, they are also considered independent contractors. This makes determining liability even more complicated.

So, if you are injured while driving an Uber, you must know the actual value of your claim before you get offered a low settlement and know whom to seek compensation from.

A Manhattan uber accident lawyer at Siler & Ingber, LLP helps you receive the total compensation you deserve for all of the liable parties.

The Uber Accident Policy

Before you hail a ride with a local Uber driver, you need to understand the coverage you have if you are involved in an accident during your ride.

Generally, Uber drivers are covered by the company’s liability insurance as long as the driver was online (actively accepting requests) before they accepted your request for the cab ride.
Remember that this can be highly deceiving as the liability limits are relatively low: $50,000 in injury liability per person injured in the accident.

If you are in an accident during your uber ride, ensure that everyone riding with you is safe and administer first aid if needed.

The next step would be to contact police and paramedics if needed. Once all immediate health issues are checked, the driver must contact Uber to begin the process of filing a claim. The driver and passengers can hear from the insurance company within 3 days of the accident to find out what they can expect.

How To Determine If Uber Is Financially Liable

Theoretically, all passengers are covered by Uber’s one million dollar liability policy regardless of who is responsible. Things can get more complicated if you get hit by an uber driver while walking or in another vehicle.

The liability in such cases depends on the status of the Uber app and if the driver had a fare in progress at the time of the auto crash.

In case the Uber app is on, and the driver is carrying a paying fare, the policy must cover any accident injuries. Uber’s policy must also cover accidents occurring after the driver accepts a new ride request but has not picked up the passenger yet.

Suppose the Uber driver is active on the Uber app, but neither has a passenger nor a pickup request. In that case, the driver is likely responsible rather than personally liable for any injury-causing accidents.

How To Determine If The Uber Driver Is Liable

If drivers are not actively using the Uber app, they are driving for personal reasons.

If the Uber driver causes an accident, the driver’s auto insurance policy must cover any injury claims.

Uber does not generally accept financial responsibilities in such cases. Instead, you might be forced to file an uninsured driver claim with your insurance policy.

How To Determine Who Is Liable For The Uber Crash?

Determining the liability in these types of car crashes can be difficult. If uber and the driver denied liability, what would be the next step?

Obtaining cell phone records or deposing the rideshare driver should be necessary. Still, your Manhattan uber accident lawyer can help determine how to best handle your claim and the evidence that needs to be collected.
