Prioritize your safety :

The first and foremost concern after a construction accident is your safety. Seek medical attention promptly, even if your injuries seem minor at first. Some injuries may not manifest immediately, and a medical professional can provide documentation of your injuries, which is crucial for your claim.

Report the accident :

Inform your employer about the accident as early as possible. Failing to report the incident promptly might complicate your claim later on. Ensure that the details of the accident are accurately documented, and keep a copy of the report for your records.

Gather evidence :

Take pictures of the accident scene, your injuries, and any tools or circumstances that could have played a role in the accident. If there were witnesses, make an effort to get in touch with them. When constructing your case with a New York construction accident attorney, these particulars might be quite helpful.

Preserve Documents :

Keep a record of all documents related to the accident, including medical bills, reports, and correspondence with your employer or insurance company. These documents serve as evidence of the extent of your injuries and their impact on your life.

Consult a construction accident lawyer :

It’s essential to seek legal counsel from a construction accident lawyer in New York who specializes in personal injury cases related to construction accidents. They possess the expertise to navigate the complex laws surrounding construction accidents and can guide you on the best course of action.

Know Your Rights :

Familiarize yourself with your rights as an injured worker in New York. Workers’ compensation is a common avenue for obtaining benefits, but in some cases, a third-party liability claim against another entity involved in the construction project may be applicable. Your lawyer can help determine the most suitable approach for your situation.

File a timely claim :

It’s important to follow the deadlines when submitting a workers’ compensation claim. If you miss these deadlines, it may be difficult for you to get paid. Your construction accident attorney will make sure that all relevant documentation is filed on time.

Negotiate or Litigate :

Your lawyer will work on your behalf to negotiate a fair settlement with the responsible parties or their insurance companies. If a fair agreement cannot be reached, they will guide you through the process of filing a lawsuit and represent you in court.

Conclusion

Experiencing a construction accident in New York City can be a daunting and overwhelming experience, but taking these steps can significantly strengthen your claim for compensation. Remember, consulting a construction accident lawyer in New York from an experienced team like Siler Ingber’s is pivotal to navigating the legal complexities and ensuring that your rights are protected throughout the process.
